Best Car Accident Lawyers in Australia
Updated 22 September 2026
Car accident lawyers claim compensation for people injured in road crashes under each state's motor accident scheme, such as the Motor Accident Injuries Act 2017 (NSW), the Transport Accident Act 1986 (Vic) and Queensland's compulsory third party (CTP) scheme regulated by the Motor Accident Insurance Commission. The first claim form is due within 3 to 12 months of the accident in most states, so the deadline for your state is the first thing to check.
Compare the ranked firms below. Before you call one, report the crash to police, get treatment and a medical certificate that lists your injuries, and note the registration of every vehicle involved. Most state schemes ask for these details when you lodge a claim.

What does a car accident lawyer do?
A car accident lawyer runs a claim against the CTP insurer or state scheme for the at-fault vehicle and recovers statutory benefits or damages. The work usually includes:
- Identify the right scheme and insurer, including nominal defendant claims for unregistered or unidentified vehicles.
- Lodge the claim form within the scheme deadline, or explain a late claim.
- Prove fault using police reports, witness statements and dash-cam footage.
- Obtain medical evidence and challenge impairment assessments.
- Dispute insurer decisions through internal review and the scheme's dispute body.
- Negotiate a lump-sum settlement for lost earnings, care and pain and suffering.
- Commence court proceedings if the claim does not settle.
Insurers have their own lawyers; this page compares lawyers for the injured person.
Motor vehicle accident lawyer and CTP lawyer
"Motor vehicle accident lawyer" and "CTP lawyer" describe the same job. The name of the scheme changes by state, which is why a lawyer who knows your state's scheme matters more than the label.
Which motor accident scheme covers your state?
Every Australian state and territory has its own motor accident injury scheme, and several of them pay benefits without proof of fault.
| State | Scheme regulator or insurer | Fault rule | First claim deadline |
|---|---|---|---|
| NSW | State Insurance Regulatory Authority (SIRA) | Statutory benefits payable regardless of fault, but weekly payments stop at 26 weeks for a driver wholly or mostly at fault; damages need another driver's fault | 3 months (within 28 days for back-paid weekly payments) |
| Victoria | Transport Accident Commission (TAC) | No-fault | 12 months (up to 3 years with reasonable grounds) |
| Queensland | Motor Accident Insurance Commission (MAIC) | Fault-based; serious injuries covered by NIISQ regardless of fault | 9 months, or 1 month after first meeting a lawyer, whichever is earlier |
| Western Australia | Insurance Commission of Western Australia (ICWA) | Fault-based; Catastrophic Injuries Support Scheme is no-fault | Report the crash online at crashreport.com.au; 3-year limit for court proceedings |
| South Australia | CTP Insurance Regulator | Fault-based; serious injuries covered by the Lifetime Support Scheme | As soon as possible; a reason is needed after 6 months; generally not accepted after 3 years |
| ACT | Motor Accident Injuries (MAI) Commission | Defined benefits on a no-fault basis | 13 weeks (late applications up to 2 years with an explanation) |
| Tasmania | Motor Accidents Insurance Board (MAIB) | Benefits through MAIB; common law compensation needs another party's fault | 12 months for an Application for Benefits |
| NT | Motor Accidents Compensation Commission (MACC) | No-fault | Within 6 months (up to 3 years may be considered) |
Step-by-step claim rules for each state are in CTP Claims After a Car Accident.
When do you need a car accident lawyer?
You need a car accident lawyer when the insurer denies liability, when you want damages beyond statutory benefits, or when your injury sits near a threshold. In NSW, damages for non-economic loss are payable only if permanent impairment is greater than 10% (Motor Accident Injuries Act 2017 (NSW), s 4.11). In Victoria, common law damages require a "serious injury", and an impairment of 30% or more is deemed serious (Transport Accident Act 1986 (Vic), s 93).
A lawyer is less often needed for the first claim form. Both the CTP Insurance Regulator in South Australia and the Insurance Commission of Western Australia say claimants can deal with the insurer directly.
How much does a car accident lawyer cost?
Car accident lawyers usually act on a conditional costs agreement: professional fees are paid only if the claim succeeds, plus an uplift that, under section 182 of the Legal Profession Uniform Law, must not exceed 25% of those fees in a litigious matter. How these agreements work, and the costs caps that apply in NSW and Queensland, are explained on No Win No Fee Lawyers in Australia.
Scheme rules also limit what a claimant recovers towards legal costs. South Australia's CTP Insurance Regulator states that if you receive more than $25,000 in compensation you can recover part of your legal fees at settlement, and at $25,000 or less you pay them yourself. Under section 174 of the Legal Profession Uniform Law (NSW, Victoria and WA), a firm must give written costs disclosure once costs are likely to exceed $750.
How to choose a car accident lawyer
Choose a car accident lawyer on these verifiable points:
- Practising certificate. Confirm it is current on your state regulator's or law society's register.
- Accredited specialist. Check for accreditation in personal injury law; see What Is an Accredited Specialist Lawyer?.
- Scheme knowledge. Ask how many claims the firm has run in your state's scheme and before its dispute body.
- Written costs terms. Check the uplift percentage, who funds disbursements and what happens if the claim fails.
- Who does the work. Ask who will run your file and attend medical and settlement conferences.

Frequently asked questions
Do I need a lawyer to make a CTP claim?
Not to lodge it. South Australia's CTP Insurance Regulator and the Insurance Commission of Western Australia both state that you can claim without a lawyer. A car accident lawyer is most useful when liability is denied, an impairment threshold is disputed or you receive a settlement offer.
Can I claim if the accident was my fault?
In NSW, statutory benefits are payable even if you caused the accident, although weekly payments stop 26 weeks after the accident if you were wholly or mostly at fault, under section 3.11 of the Motor Accident Injuries Act 2017 (NSW). Victoria's TAC and the Northern Territory's MAC Scheme are no-fault schemes. In Queensland, Western Australia and South Australia, someone else must be at least partly at fault.
What is a CTP lawyer?
A CTP lawyer is a car accident lawyer who runs claims against compulsory third party insurance, the injury cover paid with vehicle registration. The same lawyers handle TAC claims in Victoria, MAIB claims in Tasmania and claims to the Insurance Commission of Western Australia.
How long do I have to make a car accident claim?
It depends on the state. The first claim form is due within 3 months in NSW, 9 months in Queensland and 12 months in Victoria and Tasmania, and damages claims generally have a 3-year limit. Late claims need an explanation.
