Best Traffic & Drink Driving Lawyers in Australia
Updated 22 September 2026
A traffic and drink driving lawyer represents drivers charged with drink driving, drug driving, speeding, driving while suspended and other traffic offences under each state's road transport law, such as the Road Transport Act 2013 (NSW), the Road Safety Act 1986 (Vic) and the Transport Operations (Road Use Management) Act 1995 (Qld). Compare traffic and drink driving lawyers by city below, check each firm's fee model and reviews, and book a first consultation before your first court date.
Start with the paperwork you were given. A court attendance notice, penalty notice or notice of suspension states the charge, the court date and any deadline to act. Bring it, your licence and your traffic record to the first meeting. Some deadlines are short. In NSW, an appeal to the Local Court against an on-the-spot police suspension must be filed within 28 days, and an appeal against a Transport for NSW suspension must be filed before the suspension starts.

What does a traffic lawyer do?
A traffic lawyer advises on the charge, the likely penalty and the licence consequences, then represents the driver in the Local or Magistrates Court. Typical work includes:
- Advises on whether to plead guilty or defend the charge.
- Reviews police evidence, including breath, blood and oral fluid test procedures and speed detection records.
- Prepares a plea in mitigation with character references, driving records and course certificates.
- Applies for a non-conviction outcome where the offence allows it.
- Appeals licence suspensions to the Local Court in NSW and runs other licence appeals where the law allows one.
- Applies for restricted or work licences, such as a Queensland restricted licence or a Western Australian extraordinary licence.
- Negotiates with police prosecutors to amend or withdraw charges.
- Represents drivers charged with serious driving offences, such as dangerous driving, that sit between traffic and criminal law.
Do you need a drink driving lawyer?
A drink driving lawyer is most useful when the charge is mid-range or high-range, when there is a prior offence, or when losing a licence would cost a job. Most states set automatic or minimum licence disqualification periods for drink driving, and a court generally cannot go below the minimum. In NSW, the penalty table published by the NSW Government for a first high-range offence (0.15 or more) shows a maximum of 18 months' imprisonment, a maximum fine of $3,300 and an automatic 3-year disqualification that the court can reduce to no less than 12 months, as at September 2026. A mandatory interlock order also applies to that offence, and the disqualification actually served is shorter where the driver goes on to the interlock program.
Interlock programs also apply. In NSW, a mandatory interlock order applies to mid-range and high-range offences, drink driving offences committed under the influence, refusing a sample, and repeat low, novice or special range offences, so the driver must use an alcohol interlock after the disqualification ends unless the court makes an interlock exemption order. In Victoria, a driver whose licence or permit is cancelled for drink driving must have an interlock fitted before relicensing. Our guide to Drink Driving Penalties in Australia sets out the limits and penalties state by state.
When do you need a traffic lawyer?
A traffic lawyer is worth speaking to whenever the charge carries a disqualification, a possible prison term or a criminal record. The main situations are below.
After a drink or drug driving charge
Drink and drug driving charges go to court in most cases, and a conviction brings a disqualification. A lawyer can check the testing procedure and prepare the plea.
When your licence is suspended or cancelled
Suspensions come from police on the spot, from the licensing authority for demerit points, or from a court as a disqualification. The appeal options differ by state and by licence type. The guide to Licence Suspension & Disqualification explains demerit limits, good behaviour periods and appeals in each state.
When you are charged with a serious driving offence
Dangerous driving, driving causing death or injury, and police pursuit offences carry prison terms. These matters overlap with criminal law, and many firms that act in them also appear on our list of Criminal Lawyers in Australia.
When you want to defend the charge
A defended hearing needs evidence, witnesses and cross-examination. A lawyer can assess whether the prosecution can prove each element before you decide how to plead.
Traffic solicitor, traffic lawyer or barrister?
A traffic solicitor and a traffic lawyer are the same thing: a solicitor with a current practising certificate who practises traffic law. Solicitors take instructions, prepare the case and appear in the Local and Magistrates Courts. A barrister is usually briefed for a contested hearing, a District or County Court appeal, or a serious driving charge. The difference is explained in Lawyer vs Solicitor vs Barrister.
How much does a traffic lawyer cost?
Traffic lawyers commonly quote a fixed fee for a guilty plea to a drink driving or traffic charge in the Local or Magistrates Court, and charge more for a defended hearing. No body publishes standard traffic law fees, so the figures below are indicative only: they vary with the firm, the city, the court and the complexity of the matter. Ask for a written estimate before you engage anyone.
| Matter | Common fee model | Typical range (varies) |
|---|---|---|
| First consultation | Free or fixed fee | Free to around $400 |
| Guilty plea, drink driving or traffic charge | Fixed fee | Around $1,500 to $4,000 |
| Licence appeal or restricted licence application | Fixed fee | Around $1,500 to $3,500 |
| Defended hearing | Fixed fee per day or hourly rate | Around $4,000 to $10,000 or more |
| Hourly rate | Hourly, plus GST | Around $300 to $650 per hour |
Free help is limited but real. Duty lawyers at Local and Magistrates Courts give free advice on the day, and legal aid commissions apply a means and merit test. See Legal Aid in Australia for the eligibility rules and How Much Does a Lawyer Cost in Australia? for fee models in more detail.
How to choose a traffic lawyer
Run these checks before you sign a costs agreement:
- Practising certificate. Search the lawyer's name on the law society or legal regulator register in your state to confirm they hold a current practising certificate.
- Accredited specialist. Several state law societies run a specialist accreditation scheme in criminal law. Accreditation is optional, so check what it means in What Is an Accredited Specialist Lawyer?
- Written costs disclosure. In NSW, Victoria and Western Australia, the Legal Profession Uniform Law requires a law practice to disclose the basis of its costs and an estimate of total costs.
- Local court experience. Ask how often the lawyer appears in the court where your matter is listed.
- Licence outcome. Ask the lawyer to explain, in writing, the minimum disqualification that applies and whether any work licence or appeal option exists in your state.
Our ranking method is set out in how we rank law firms, and How to Choose a Lawyer in Australia covers the general checks.

Frequently asked questions
Can a traffic lawyer help me keep my licence?
A traffic lawyer can apply for a court outcome without a conviction where the law allows it, run a licence appeal, or apply for a restricted or work licence in the states that offer one. Minimum disqualification periods for drink driving generally bind the court, so the scope to keep a licence depends on the offence and the state.
Is a drink driving lawyer different from a traffic lawyer?
No. There is no separate licence or accreditation for drink driving work. Solicitors who practise traffic law handle drink driving, drug driving, speeding, licence suspension and disqualified driving matters.
Do I have to go to court for a low-range drink driving offence?
Not always. In NSW, police have a discretion to deal with a first low-range offence by penalty notice instead of a court attendance notice, and several other states and territories also allow a first low-range offence to be expiated by an infringement notice in some cases. The rules differ in each state, so check the notice you were given. Mid-range and high-range offences go to court.
Can I get free legal help for a traffic charge?
Duty lawyers at Local and Magistrates Courts can give free advice on the day of court. Legal aid commissions apply means and merit tests, and legal aid for traffic matters is limited.
How soon should I contact a traffic lawyer?
As soon as you receive a court attendance notice or a suspension notice. In NSW, an appeal against an on-the-spot police suspension must be filed within 28 days, and an appeal against a Transport for NSW suspension must be filed before the suspension starts.
