Where are defamation cases heard for Sydney?
Defamation proceedings are heard in the Supreme Court of NSW, where they are managed in a specialised defamation list in the Common Law Division at 184 Phillip Street, Queens Square. The District Court also hears defamation claims, and its main Sydney courthouse is John Maddison Tower, 86–90 Goulburn Street. Defamation claims can also be brought in the Federal Court of Australia.
What NSW-specific rules apply?
NSW follows the uniform Defamation Act 2005 (NSW), amended from 1 July 2021 to add a serious harm element (section 10A) and mandatory concerns notices (sections 12A and 12B). The limitation period is 1 year from publication under section 14B of the Limitation Act 1969 (NSW), which the court can extend to up to 3 years. Either party can elect a jury trial, and damages for non-economic loss are capped at an amount the Minister declares each year.
How much does a defamation lawyer cost in Sydney?
Fees for defamation lawyers in Sydney depend on the matter, the lawyer's seniority and the fee model (hourly, fixed fee or conditional). Before any work starts, a law firm must disclose its costs in writing when they are likely to exceed the disclosure threshold. See How Much Does a Lawyer Cost in Australia? for typical ranges and fee models.

How long do I have to sue for defamation in Sydney?
Defamation proceedings in Sydney must be started within 1 year of publication. The court can extend this to up to 3 years if it is just and reasonable, and a concerns notice given late in the year can extend the period by up to 56 days.
What is the serious harm test in NSW defamation?
Under section 10A of the Defamation Act 2005 (NSW), the plaintiff must prove the publication caused, or is likely to cause, serious harm to their reputation. The judge, not the jury, decides this, often before trial.
I have received a concerns notice in Sydney. What happens next?
The publisher has 28 days to make a written offer to make amends, such as a correction, apology or payment. A reasonable offer that is refused can later be used as a defence, so publishers often take legal advice within that window.
