Where are wills and estates matters heard for Sydney?
Probate, letters of administration and family provision claims are handled by the Supreme Court of NSW, which sits in the Law Courts Building at 184 Phillip Street, Queens Square. Contested matters run in the Succession and Probate List of the Court's Equity Division, which has separate list judges for probate and family provision. Notices of intended application, notices of filing of accounts and notices of intended distribution are all published through the NSW Online Registry.
What NSW-specific rules apply?
Wills, intestacy and family provision in NSW are governed by the Succession Act 2006 (NSW), and grants are made under the Probate and Administration Act 1898 (NSW). A family provision application must be made within 12 months of death unless the Court orders otherwise or the parties consent to a late claim. NSW is the only state where the Court can designate property outside the estate as notional estate, so assets such as jointly held property can be exposed to a claim.
How much does a wills and estates lawyer cost in Sydney?
Fees for wills & estates lawyers in Sydney depend on the matter, the lawyer's seniority and the fee model (hourly, fixed fee or conditional). Before any work starts, a law firm must disclose its costs in writing when they are likely to exceed the disclosure threshold. See How Much Does a Lawyer Cost in Australia? for typical ranges and fee models.

Sydney will FAQs

No. The executor must first publish a notice of intended application on the NSW Online Registry, and the probate application can only be filed 14 days after that notice.

Yes. Under the Succession Act 2006 (NSW) the Supreme Court can designate certain property as notional estate, including some assets that passed outside the will, and use it to satisfy a family provision order.
